Terms of Service

1. Acceptance

By accessing or using RevTouch.io (the "Service") you agree to these Terms. If you are agreeing on behalf of an organization, you confirm you have authority to bind it. If you do not agree, do not use the Service.

2. The Service

RevTouch is a multi-tenant marketing attribution and affiliate payout platform. It records marketing touches once, reports them fractionally across attribution models, and elects exactly one payable touch per conversion through a deterministic, auditable payout ledger.

3. Accounts

• Provide accurate registration information and keep it current
• Keep credentials and organization write keys secret; you are responsible for activity under them
• Notify us immediately of unauthorised access
• Creating an account confirms you accept these Terms and the Privacy Policy

4. Subscriptions and billing

• Fees are billed in advance monthly or annually via Stripe
• Trials, where offered, convert to a paid plan unless cancelled before the trial ends
• Prices may change on reasonable notice, effective at the next renewal
• Fees are non-refundable except where required by law
• You are responsible for applicable taxes
• Cancel at any time; access continues to the end of the paid period

5. Your responsibilities as a controller

You decide what data flows into RevTouch. You represent and warrant that, for every jurisdiction where your visitors are located, you will:

• Publish a privacy notice that discloses the tracking and names RevTouch as a processor
• Obtain any consent required for cookies or tracking (EU/UK ePrivacy) before firing the collector
• Honour opt-out and Global Privacy Control signals on your own site
• Not send us special category data, payment card data, or data about known children
• Pass through data subject requests you receive that concern data held in RevTouch

Our Data Processing Agreement is incorporated into these Terms by reference and applies automatically.

6. Acceptable use

• No unlawful use, and no violation of any applicable privacy or marketing law
• No attempt to access another organization's data or defeat row-level security
• No interference with, or excessive load on, the collector or API
• No malware, scraping, resale of the Service, or spam
• No use of the Service to build cross-site advertising profiles of individuals

7. Intellectual property and your data

• RevTouch owns the Service, its software and documentation
• You retain ownership of the data you submit
• You grant us a limited licence to process that data solely to provide the Service
• We may use aggregated, de-identified statistics that cannot identify you or any person

8. Affiliate payouts

RevTouch computes payout decisions from the rules you configure. We do not move money and are not a payment processor for commissions. The elected winner, the rule that won, and any manual override are written to an append-only audit log. You remain solely responsible for the commercial terms with your partners, for paying them, and for tax and reporting obligations arising from those payments.

9. Availability and support

We target high availability but do not warrant uninterrupted access. Planned maintenance is announced in advance where practical. Ingest is designed to fail open and buffer rather than drop events, but you should retain your own source records.

10. Disclaimer

Except as expressly stated, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Attribution and payout outputs are decision support, not financial or legal advice.

11. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenue. Our aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded: including, for consumers in the EEA and UK, your mandatory statutory rights.

12. Indemnity

You will indemnify RevTouch against claims arising from your data, your use of the Service, or your breach of these Terms or of any privacy law applicable to your tracking.

13. Termination and deletion

Either party may terminate for material breach not cured within 30 days. We may suspend immediately for security or unlawful use. On termination you may export your data for 30 days, after which we delete or de-identify it within a further 30 days, except records we must retain by law (billing and payout records for 7 years). Request deletion at any time from Settings → Privacy & data.

14. Privacy rights

EEA, UK and Swiss residents hold the rights described in our Privacy Policy. Residents of 20 US states with consumer privacy laws in force: including California (CCPA/CPRA), Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Florida, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky and Rhode Island: hold rights of access, correction, deletion, portability, opt-out and appeal.

We do not sell personal information and do not share it for cross-context behavioural or targeted advertising. You will never be discriminated against for exercising a privacy right. Exercise rights in-app or at privacy@revtouch.io.

15. Changes

We may update these Terms. Material changes are notified by email or in-app at least 30 days before they take effect, and continued use after that date constitutes acceptance. Where law requires it, we obtain renewed consent instead.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict of law rules, and the parties submit to the courts located there. Nothing in this clause removes the right of a consumer in the EEA or UK to bring proceedings in their country of residence or to rely on mandatory local law.
